Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") is an integral part of the Terms of Service ("TOS") between HostingSwift, LLC and MiTi Telecom, LLC (the "Company") and you (the "User"). This AUP governs the use of all services provided by the Company (the "Services") and is designed to protect the security, integrity, and reliability of our network and the rights of all our users.
Violation of this AUP may result in the suspension or termination of your Services. This policy applies to all services offered by the Company, including but not limited to Web Hosting, VPS, Dedicated Servers, Radio Hosting, Domain Registration, VPN, and Internet Services.
1. General Prohibitions
The following activities are strictly prohibited across all our Services:
- Illegal Activities: Using the Services for any purpose that violates federal, state, or international laws. This includes, but is not limited to, the transmission of fraudulent materials, phishing, or engaging in any form of identity theft.
- Intellectual Property Infringement: Transmitting, distributing, or storing any material in violation of any applicable law or regulation, including material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization.
- Harmful or Abusive Content: Disseminating content that is unlawful, abusive, libelous, defamatory, obscene, or that promotes hate, violence, or discrimination against any group. This includes a strict prohibition on any content related to child exploitation.
- Distribution of Malicious Software: Knowingly hosting or distributing malware, viruses, trojan horses, worms, or any other software designed to cause damage or gain unauthorized access to a computer system.
2. System and Network Security
Users are prohibited from violating or attempting to violate the security of the Company's network. Violations of system or network security may result in civil or criminal liability. Prohibited activities include:
- Gaining unauthorized access to any account, system, or network.
- Interfering with service to any user, host, or network, including, without limitation, mail-bombing, flooding, or deliberate attempts to overload a system.
- Conducting network scanning, port scanning, or any other procedure designed to probe security measures without explicit authorization.
- Forging any TCP/IP packet header or any part of the header information in an email or a newsgroup posting.
3. Email and Messaging Policy (Zero-Tolerance Spam)
We maintain a zero-tolerance policy for Unsolicited Commercial Email (UCE) or "spam." Users are strictly prohibited from sending spam from or through our network. This includes:
- Sending any email to persons who have not explicitly consented to receive it.
- Operating open mail relays or open proxies.
- Using purchased email lists or "safe lists."
Any account found to be involved in the transmission of spam will be immediately terminated, with or without notice.
4. Resource Usage Policy
This policy applies primarily to our hosting services (Shared, VPS) but extends to network usage for all services. Users may not consume an excessive amount of server resources in a way that negatively impacts the stability, performance, or security of our servers or network.
Prohibited activities constituting resource abuse include, but are not limited to:
- CPU, Memory, and I/O Usage: Running scripts or processes that consistently consume a disproportionate amount of CPU, RAM, or disk I/O, including cron jobs scheduled more frequently than every 15 minutes.
- Inode Usage: Storing an excessive number of files and folders (inodes) that exceeds the limits specified for your hosting plan. This is typically caused by unpurged caches, email, or error logs.
- Database Usage: Making an excessive number of database queries or maintaining an unreasonable number of concurrent database connections that strain the database server.
- Cryptocurrency Mining: Running any software related to the mining of cryptocurrencies is strictly forbidden on all hosting platforms.
- Backup and Storage: Using hosting accounts as a primary device for file backup, archival, or data storage is not permitted. Backups of your website content are acceptable, but archival of personal or external files is not.
While VPS and Dedicated Server plans provide dedicated resources, users are still prohibited from using these services in any way that could harm the integrity of our network, such as participating in DDoS attacks or other abusive network activities.
5. Service-Specific Prohibitions
A. Hosting Services (Web, VPS, Dedicated Servers)
- Prohibited Daemons/Services: Running services such as public IRC servers, TOR exit nodes, or public proxy servers is not permitted on shared or VPS hosting plans without prior written consent.
B. Radio Server Hosting
- Copyright Compliance: Users are solely responsible for obtaining and maintaining all necessary licenses and paying all royalties for the content they broadcast (e.g., from ASCAP, BMI, SESAC, SoundExchange). Broadcasting copyrighted material without the appropriate licenses is a direct violation of this policy.
C. VPN and Internet Services (ISP)
- Network Abuse: Users may not use the service to conduct Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks against any target.
- Illegal File Sharing: Transmitting or sharing copyrighted files through peer-to-peer (P2P) networks or other means without proper authorization is strictly prohibited.
- Account Sharing: VPN accounts are for individual use and may not be shared with others.
6. Enforcement
The Company reserves the right to investigate any suspected violation of this AUP. If we become aware of a violation, we may take any of the following actions:
- Issue a warning to the User.
- Suspend access to the User's account or Services.
- Terminate the User's account without notice.
- Report the illegal activity to the appropriate law enforcement authorities.
We will determine the appropriate course of action at our sole discretion.
7. Reporting Violations
To report a violation of this AUP, please contact us with detailed information, including any relevant logs or evidence. All reports should be sent to our abuse department.
8. Revisions to this AUP
The Company reserves the right to modify this AUP at any time, effective upon posting to our website. Your continued use of the Services after such a modification constitutes your acceptance of the revised policy.
